SAM’S CAR WASH TERMS OF USE AND SERVICE:

PLEASE READ THESE TERMS OF USE CAREFULLY.
These Terms of Use (“Terms”) govern your use of Sam’s Car Wash locations, car wash services, websites, online checkout systems, customer accounts, unlimited wash memberships, and related products and services (collectively, the “Services”).
For purposes of these Terms, “Sam’s Car Wash,” “Sam’s,” “Company,” “we,” “our,” and “us” mean Sam’s Car Wash and the applicable affiliated entity that owns, operates, or provides the applicable Service.
By purchasing or using our Services, creating an account, enrolling in a membership, or using our website, you agree to these Terms.
If you do not agree to these Terms, you should not use the applicable Services.
1. USE OF OUR CAR WASH
Customers are responsible for determining whether their vehicle can safely use our car wash equipment and for following all posted signs and employee instructions.
When using a conveyor or automatic wash, you must:

• Follow all attendant instructions;

• Properly position your vehicle;

• Place the vehicle in neutral when instructed;

• Keep the vehicle in neutral while traveling through the conveyor unless instructed otherwise;

• Keep your foot off the brake while on the conveyor unless instructed otherwise;

• Refrain from steering while on the conveyor unless instructed otherwise;

• Turn off automatic windshield wipers;

• Disable automatic braking, auto-hold, parking assist, or similar systems when necessary;

• Make sure all windows, doors, sunroofs, trunks, tailgates, hoods, and other openings are completely closed;

• Secure or remove loose exterior items;

• Retract or remove antennas when appropriate; and

• Follow the exit instructions when leaving the wash.

You are responsible for understanding how to operate your particular vehicle, including how to place it into and out of neutral and how to disable automatic vehicle features when necessary.
Failure to follow instructions may result in damage to your vehicle, another vehicle, or car wash equipment.
2. VEHICLE ELIGIBILITY
Our car wash equipment is designed primarily for standard passenger vehicles that are properly maintained and equipped with securely attached factory components.
Certain vehicles, modifications, accessories, or vehicle conditions may not be suitable for automatic car washing.
You should notify an employee before entering the wash if your vehicle has any condition or equipment that could increase the risk of damage, including:

• Oversized or aftermarket wheels or tires;

• Low-profile tires;

• Lifted or lowered suspension;

• Retractable or aftermarket running boards;

• Trailer hitches;

• Hitch-mounted accessories;

• Roof racks;

• Bicycle racks;

• Ski racks;

• Ladder racks;

• Cargo carriers;

• Exterior spare tires;

• Aftermarket spoilers;

• Large factory spoilers;

• Bug shields;

• Window visors;

• Aftermarket antennas;

• Magnetic signs;

• Vehicle wraps or decals;

• Decorative accessories;

• Loose license plates or plate frames;

• Loose trim, molding, or emblems;

• Damaged mirrors;

• Cracked or chipped glass;

• Prior collision damage;

• Loose or peeling paint;

• Rust or corrosion; or

• Unsecured items in a pickup truck bed.

Sam’s Car Wash reserves the right to refuse to wash a vehicle that we reasonably believe cannot safely use our equipment.
Our decision to permit a vehicle to enter the wash does not constitute a representation or warranty that the vehicle or every component on the vehicle is capable of safely passing through automatic car wash equipment.
3. PRE-EXISTING CONDITIONS AND VEHICLE COMPONENTS
To the fullest extent permitted by law, Sam’s Car Wash is not responsible for damage caused by or resulting from a pre-existing condition, defect, deterioration, modification, or improperly secured vehicle component.
Examples include damage involving:

• Loose, cracked, damaged, worn, or deteriorated components;

• Rust or corrosion;

• Loose or peeling paint or clear coat;

• Previously damaged or repaired body panels;

• Loose trim, molding, emblems, or weather stripping;

• Damaged mirrors;

• Cracked, chipped, or previously damaged glass;

• Aftermarket parts or accessories;

• Improperly installed equipment;

• Vehicle wraps, graphics, decals, or magnetic signs;

• Manufacturer defects or recalls; or

• Components that fail during the ordinary operation of properly functioning car wash equipment because of their condition.

Nothing in these Terms is intended to eliminate liability that cannot legally be waived or to relieve Sam’s Car Wash of responsibility for damage that is legally determined to have been directly caused by our negligence or malfunctioning equipment.
4. DAMAGE CLAIMS
If you believe your vehicle was damaged while using a Sam’s Car Wash, please report the concern to a manager or employee as soon as reasonably possible, preferably before leaving the property.
Prompt reporting gives us the best opportunity to:

• Inspect the vehicle;

• Inspect our equipment;

• Review surveillance footage;

• Review wash records;

• Speak with employees;

• Photograph the claimed damage; and

• Determine the circumstances surrounding the incident.

A damage report, investigation, inspection, or communication from Sam’s Car Wash is not an admission of liability.
We may request information reasonably necessary to investigate a claim, including:

• Your name and contact information;

• Vehicle make, model, and year;

• License plate number;

• Date and approximate time of the wash;

• Transaction or membership information;

• Photographs;

• Repair estimates;

• Repair invoices; and

• Other relevant information.

You should give Sam’s Car Wash a reasonable opportunity to inspect claimed damage before repairs are performed when reasonably possible.
Sam’s Car Wash may consider surveillance footage, photographs, equipment records, employee observations, vehicle condition, prior damage, repair estimates, and any other relevant evidence when evaluating a claim.
Each claim will be evaluated based on its individual facts and applicable law.
5. PERSONAL PROPERTY
Customers are responsible for securing personal property located inside, on, or around their vehicles.
Except where liability cannot legally be excluded, Sam’s Car Wash is not responsible for personal property that is lost, stolen, misplaced, or damaged while on our premises.
This includes items located:

• Inside a vehicle;

• In a truck bed;

• On a roof or exterior carrier;

• In cup holders or door compartments;

• In vacuum areas; or

• Elsewhere on Sam’s Car Wash property.

Please secure valuables before using our Services.
6. WASH RESULTS
The effectiveness of a car wash depends on factors including vehicle condition, paint condition, contamination, weather, vehicle design, and the length of time substances have remained on the vehicle.
A standard car wash may not completely remove substances such as:

• Tree sap;

• Road tar;

• Paint or overspray;

• Concrete;

• Adhesives;

• Oxidation;

• Embedded brake dust;

• Heavy mud;

• Industrial fallout;

• Certain insects;

• Bird droppings; or

• Other bonded contaminants.

Purchase of a wash does not guarantee removal of every contaminant.
If you are dissatisfied with the quality of your wash, please notify us promptly so we have an opportunity to address your concern.
7. CUSTOMER CONDUCT AND SAFETY
Customers must behave safely and lawfully while on Sam’s Car Wash property.
You may not:

• Enter restricted or employee-only areas;

• Enter an operating wash tunnel on foot unless instructed by an employee;

• Tamper with equipment;

• Intentionally damage Company property;

• Drive recklessly;

• Speed through the property;

• Threaten, intimidate, abuse, or harass employees or customers;

• Operate a vehicle while impaired;

• Block entrances, exits, wash lanes, or other customers;

• Engage in fraudulent activity; or

• Use our property or Services for an unlawful purpose.

We may refuse service, suspend membership privileges, terminate a customer account, or require a person to leave the property when reasonably necessary for safety, security, fraud prevention, employee protection, customer protection, or business operations.
UNLIMITED WASH MEMBERSHIPS
8. MEMBERSHIP PROGRAM
Sam’s Car Wash may offer unlimited or recurring wash membership plans (“Memberships”).
Membership pricing, included wash services, promotional pricing, and other plan-specific benefits will be disclosed at enrollment.
Unless specifically stated otherwise:

• A Membership is assigned to one vehicle;

• Memberships may not be shared between vehicles;

• Memberships may not be transferred without our authorization;

• Membership benefits have no cash value;

• Memberships are intended for the vehicle registered to the account; and

• Sam’s Car Wash may use a license plate, RFID tag, barcode, or other identifier to verify Membership eligibility.

Attempting to move, copy, manipulate, alter, or otherwise use a Membership identifier on an unauthorized vehicle may result in immediate suspension or cancellation of the Membership.
We may impose reasonable usage restrictions designed to prevent fraud, abuse, resale, commercial exploitation, or unauthorized sharing.
9. AUTOMATIC RENEWAL
Unless otherwise expressly stated at enrollment, Memberships are automatically renewing subscriptions.
When you enroll, you authorize Sam’s Car Wash and our payment processors to automatically charge the payment method associated with your account at the price and billing frequency disclosed to you during enrollment.
Your Membership will continue to renew until canceled.
Before you enroll, we will provide the applicable recurring price, billing frequency, renewal information, and available cancellation methods as required by applicable law.
If you enroll using promotional pricing, any price that will apply after the promotional period will be disclosed as required by applicable law.
10. CANCELLATION
You may cancel your Membership at any time.
Sam’s Car Wash will provide cancellation methods that comply with applicable law and are designed not to unreasonably delay, hinder, or obstruct cancellation.
Depending on how you enrolled and the cancellation methods made available to you, cancellation may be available:

• Through our website or online membership management system;

• Through a direct electronic cancellation link;

• By telephone;

• In person at a participating Sam’s Car Wash location; or

• Through another method disclosed at enrollment.

Where required by law, the cancellation method will be at least as easy to use as the method used to enroll and will be available through the same medium used to enroll.
Once a valid cancellation request becomes effective, no additional recurring Membership charges will be made.
Unless otherwise required by law, cancellation does not create a refund for a Membership period that has already been paid.
Membership benefits may remain available through the end of the paid Membership period unless otherwise disclosed.
11. MEMBERSHIP REFUNDS
Unless otherwise required by law or expressly provided by Sam’s Car Wash:

• Membership payments are nonrefundable once charged;

• Partial Membership periods are not prorated;

• Failure to use the Membership does not entitle the member to a refund;

• Temporary inability to use a vehicle does not automatically entitle the member to a refund; and

• Temporary location closures do not automatically entitle the member to a refund.

Nothing in this provision affects rights or remedies that cannot legally be waived.
12. DECLINED PAYMENTS
If a recurring Membership payment is declined, expired, rejected, or otherwise unsuccessful, you authorize Sam’s Car Wash or our payment processor to make additional reasonable attempts to process the authorized payment.
Membership benefits may be suspended while payment remains outstanding.
If payment cannot be successfully processed, we may terminate the Membership.
13. CHANGING VEHICLES
A Membership may only be used with the vehicle associated with that Membership.
Customers may request to change the vehicle associated with a Membership.
Sam’s Car Wash may require reasonable information to verify the new vehicle and prevent fraudulent or repeated transfers of Membership benefits.
We reserve the right to restrict excessive or suspicious vehicle changes.
14. MEMBERSHIP MISUSE
Membership privileges may be suspended or terminated for:

• Sharing a Membership with another vehicle;

• Manipulating a license plate or Membership identifier;

• Providing false account or vehicle information;

• Fraudulent chargebacks;

• Unauthorized use;

• Abuse of employees;

• Unsafe conduct;

• Intentional misuse of equipment; or

• Material violation of these Terms.

Termination for fraud, misuse, or misconduct does not necessarily entitle the member to a refund.
15. MEMBERSHIP PRICE AND BENEFIT CHANGES
Sam’s Car Wash may change Membership pricing, wash packages, included benefits, or other Membership terms from time to time.
We will provide notice of material changes when required by applicable law.
Where applicable, customers may cancel before a price change takes effect.
We will not charge a new or increased recurring price without providing any notice or consent required by applicable law.
16. PROMOTIONAL OFFERS
Membership promotions may be limited to:

• New members;

• Particular locations;

• Particular Membership plans;

• Particular vehicles;

• Particular enrollment channels; or

• A stated promotional period.

Promotional offers may not be combined unless specifically stated otherwise.
Sam’s Car Wash may refuse or cancel promotional pricing where we reasonably determine that a customer is repeatedly canceling and re-enrolling for the primary purpose of obtaining introductory offers intended for new members.
Any recurring price that applies after a promotion or free trial will be disclosed in accordance with applicable law.
PAYMENTS AND ACCOUNTS
17. PAYMENT AUTHORIZATION
By providing a payment method, you represent that you are authorized to use that payment method.
You authorize us and our payment processors to process charges you authorize, including recurring Membership payments.
You are responsible for maintaining accurate payment and account information.
18. PAYMENT DISPUTES AND CHARGEBACKS
If you believe a charge is incorrect, we encourage you to contact Sam’s Car Wash promptly so we can investigate.
Nothing in these Terms prevents you from exercising a lawful right to dispute an unauthorized or incorrect charge.
However, knowingly submitting a false or fraudulent payment dispute may result in suspension or termination of your account or Membership and any other remedies available under applicable law.
19. ACCOUNT INFORMATION AND SECURITY
If you create an account or provide information to Sam’s Car Wash, you agree to provide information that is reasonably accurate and current.
This information may include:

• Name;

• Email address;

• Telephone number;

• Payment information;

• License plate number;

• Vehicle information; and

• Account credentials.

You are responsible for protecting passwords or other account credentials.
Please notify us if you believe your account has been accessed or used without authorization.
COMMUNICATIONS AND PRIVACY
20. ELECTRONIC COMMUNICATIONS
By providing an email address or using an online customer account, you agree that Sam’s Car Wash may provide account-related notices, disclosures, receipts, Membership information, and other communications electronically where permitted by law.
Electronic communications may include email, account messages, website notices, or text messages where permitted.
Where applicable law requires a communication to be provided in writing, an electronic communication may satisfy that requirement to the extent permitted by law.
21. TEXT MESSAGES
Transactional Messages
If you provide a mobile telephone number, Sam’s Car Wash may send you transactional or service-related text messages as permitted by applicable law.
These messages may concern:

• Receipts;

• Membership enrollment;

• Membership status;

• Billing;

• Payment failures;

• Cancellations;

• Account security;

• Customer service;

• Location closures; or

• Other service-related matters.

Consent to receive transactional communications does not by itself constitute consent to receive promotional text messages where separate consent is required.
Marketing Messages
Sam’s Car Wash may offer customers the opportunity to separately consent to promotional or marketing text messages.
Where required, consent to receive automated or promotional text messages will be obtained separately from acceptance of these Terms.
Consent to receive promotional text messages is not a condition of purchasing goods or services from Sam’s Car Wash.
Message frequency may vary.
Message and data rates may apply.
Customers may revoke consent to marketing text messages at any time through a reasonable opt-out method.
Where reply texting is available, customers may use standard opt-out responses such as:
STOP to Opt Out.
We may send a final message confirming that an opt-out request has been processed.
Customers may reply HELP where supported for additional assistance.
Sam’s Car Wash will honor valid opt-out requests within the time required by applicable law.
Sam’s Car Wash is not responsible for messages that are delayed or not delivered because of circumstances outside our reasonable control.
22. EMAIL MARKETING
Customers who receive promotional emails may unsubscribe using the unsubscribe mechanism contained in those messages.
Unsubscribing from marketing communications does not prevent us from sending transactional, billing, security, Membership, or account-related communications that are otherwise permitted by law.
23. VIDEO SURVEILLANCE
For safety, security, quality control, fraud prevention, incident investigation, and business operations, Sam’s Car Wash locations may use video surveillance.
Surveillance footage may be reviewed in connection with:

• Vehicle damage claims;

• Customer incidents;

• Accidents;

• Employee or customer safety;

• Theft;

• Fraud;

• Property damage; or

• Law-enforcement requests.

Surveillance recordings remain the property of Sam’s Car Wash.
We may preserve, disclose, or provide relevant recordings to insurers, attorneys, law enforcement, governmental authorities, or other parties where reasonably appropriate or legally required.
The presence of cameras does not guarantee that every vehicle, incident, component, or area will be visible or recorded.
24. LICENSE PLATE AND VEHICLE INFORMATION
Sam’s Car Wash may collect and use license plate numbers and related vehicle information for legitimate business purposes including:

• Membership identification;

• Membership administration;

• Fraud prevention;

• Vehicle identification;

• Transaction processing;

• Customer service;

• Incident investigation;

• Security; and

• Business operations.

Any personal information we collect will be handled in accordance with applicable law and any Privacy Policy posted by Sam’s Car Wash.
WEBSITE USE
25. ACCEPTABLE USE
You may use our website and online Services only for lawful purposes.
You may not intentionally:

• Attempt to gain unauthorized access to our systems;

• Interfere with website security;

• Introduce malicious software;

• Scrape or automatically extract information in a manner that disrupts our Services;

• Impersonate another person;

• Use another customer's account without permission;

• Commit fraud; or

• Use our website in violation of applicable law.

We may suspend or restrict access where reasonably necessary to protect our customers, systems, or business.
26. INTELLECTUAL PROPERTY
The Sam’s Car Wash name, logos, branding, graphics, website content, photographs, and other proprietary materials are owned by Sam’s Car Wash or their respective licensors and may be protected by copyright, trademark, and other laws.
You may not use our trademarks or proprietary materials for commercial purposes without authorization.
27. THIRD-PARTY SERVICES
We may use third-party providers for services including:

• Payment processing;

• Membership administration;

• Website hosting;

• Customer communications;

• Text messaging;

• Email;

• Analytics;

• License plate recognition; and

• Customer support.

Third-party services may be governed by additional terms or privacy practices.
Sam’s Car Wash is not responsible for the independent acts or omissions of third-party websites or services except to the extent otherwise required by law.
GENERAL TERMS
28. SERVICE AVAILABILITY
Operating hours and Service availability may change because of circumstances including:

• Weather;

• Equipment maintenance;

• Repairs;

• Utility interruptions;

• Safety concerns;

• Staffing;

• Holidays;

• Government action;

• Emergencies; or

• Other operational circumstances.

Membership does not guarantee uninterrupted access to a particular location, tunnel, wash package, or piece of equipment.
29. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR WEBSITE AND ONLINE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
WE DO NOT GUARANTEE THAT OUR WEBSITE OR ONLINE SERVICES WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, OR UNINTERRUPTED.
NOTHING IN THIS SECTION DISCLAIMS A WARRANTY OR CONSUMER RIGHT THAT CANNOT LEGALLY BE DISCLAIMED.
30. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAM’S CAR WASH WILL NOT BE RESPONSIBLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES.
SAM’S CAR WASH IS NOT RESPONSIBLE FOR LOSSES CAUSED BY CIRCUMSTANCES OUTSIDE ITS REASONABLE CONTROL.
NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY OR A CONSUMER REMEDY THAT CANNOT LEGALLY BE LIMITED, EXCLUDED, OR WAIVED.
31. CUSTOMER RESPONSIBILITY FOR MISCONDUCT
To the extent permitted by law, a customer may be responsible for reasonable losses, repair costs, cleanup costs, or third-party claims caused by the customer's intentional misconduct, unlawful acts, fraud, vandalism, or intentional misuse of Sam’s Car Wash property.
32. GOVERNING LAW
These Terms and your relationship with Sam’s Car Wash will be governed by the laws of the State of Maryland, except where another law is required to apply.
Nothing in these Terms limits rights or remedies provided by applicable consumer-protection law that cannot legally be waived.
33. CHANGES TO THESE TERMS
We may update these Terms from time to time.
When we do, we will update the “Last Updated” date appearing above.
We will provide any additional notice or obtain any additional consent required by law before a material change becomes effective.
Changes to recurring Membership pricing or automatic-renewal terms will be handled in accordance with applicable law.
34. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.
35. NO WAIVER
Failure by Sam’s Car Wash to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.
36. ASSIGNMENT
Sam’s Car Wash may assign or transfer these Terms in connection with a merger, acquisition, sale, corporate reorganization, transfer of a location or business, or other lawful business transaction.
Customers may not transfer Membership rights or obligations except as expressly permitted by Sam’s Car Wash.
37. ENTIRE AGREEMENT
These Terms, together with any applicable Membership enrollment disclosures, promotional terms, Privacy Policy, and other terms expressly presented in connection with a particular Service, constitute the applicable agreement relating to those Services.
If specific promotional or Membership terms conflict with these general Terms, the more specific terms will control with respect to that promotion or Membership, subject to applicable law.
